We, Viba Fima Inc. and its affiliates, are committed to the privacy of our VIP members. We developed the Vibase web sites to serve you, the VIP member. The following Privacy Policy discloses our information collection practices. This means that the following policy will tell you what personally identifiable information is collected, where the information comes from, who we share this information with, and how your information is used, protected and stored. Finally, Viba Fima and its affiliates are the sole owners of the information collected on this site or through the use of this site; and we will sell, share, or rent this information only as described within the Vibase Privacy Policy, as described below.

DEFINITIONS OF INFORMATION COLLECTED

Viba Fima Inc. and its affiliates (also referred to as "Viba Fima", "We", "Us" or "Our") define PUBLIC INFORMATION to be any information that we can collect from publicly available sources or that you provide for public publication. Examples of PUBLIC INFORMATION are your Business Address, Hours of Business, Type of Business, etc.

We define PRIVATE INFORMATION as that information which is not normally available to the public and includes personal data such as private contact information, ordering and transaction information. 

We define CONFIDENTIAL INFORMATION as that information you provide to us for the conduct of business on the Vibase, but that we never use for marketing nor product development purposes, in house or in partnership with a third party. Examples of CONFIDENTIAL information include your VIP password.

INFORMATION SOURCES

We collect public, private and confidential information about you from the following sources:

• Information we receive from you on forms or online
• Information from your transactions with us such as orders, account balance or order history
• Information about your usage of the web site (see "Log Files and Cookies" below)
• Information from public sources such as the telephone directory
• Information procured from third parties such as the local chamber of commerce, credit reporting agencies, and the census bureau for demographic or geographic information

More specific information sources:

Registration Information

In order to use the Vibase web sites, you must first complete the registration process. During registration you are required to give or verify your business name, address, and phone number. This information is deemed PUBLIC information. You are also required to provide the name, phone number, address and e-mail of the person to be contacted at your business. This information is deemed PRIVATE information. The contact's title and fax number are not prerequisites to VIP membership but are encouraged so we can reduce response times and improve our service to you.

Your VIP membership is associated with a VIP username (assigned by us) and a corresponding password (selected by you). The username is PUBLIC information and the password is CONFIDENTIAL information.

Log files and Cookies

We track your usage of the Vibase. The purpose is to enhance your experience with the site. The software that serves the Web pages automatically logs all Web page requests into log files. We analyze the log files to administer the Vibase site, identify bottlenecks and trends, among other things. We consider this information PRIVATE information. As such we use the tracking information in an aggregate manner, not linked to personally identifiable information. One exception is if our system is hacked into. In this case, we will use all the tracking information we have collected to identify the transgressor.

A cookie is a piece of data stored on the user?s hard drive by a web site containing information about the user. The Vibase may or may not use cookies. If we ever do, we consider any cookies under our control to be PRIVATE information which can be revealed to our business partners only in a personally non-identifiable manner. Through our site, our business partners may use their own cookies which are outside of our control. We will require them to disclose to you their use of the cookies.

HOW THE INFORMATION IS USED

Public Information

Unless stated otherwise, all PUBLIC information entered into the Vibase may be used by us or our assignees or delegates for marketing and product development purposes without aggregation or filtering to produce VIP members' anonymity.

Private Information

We reserve the right to use PRIVATE information for marketing and product development purposes, after ensuring that aggregation and filtering procedures have been set up to protect VIP members' anonymity.

Confidential Information

CONFIDENTIAL information is used to conduct business on the Vibase.  We never use such information for marketing nor product development purposes, in house or in partnership with a third party.

SHARING INFORMATION OUTSIDE VIBA FIMA

We maintain relationships with multiple outside organizations or third parties. These third parties assist us in increasing the value of your VIP membership. How we use your information is dependent upon the type of relationship we have with these third parties. Outlined below are specific explanations of our policies toward third-party information usage.

Third Party -- Information Provider

As mentioned under Information Sources, we may purchase or procure information about you from third-party information providers. Such information will supplement the PUBLIC and PRIVATE information that you provide or that we collect from your use of the Vibase.

Examples of third-party information providers we might use:
o The Census Bureau for demographic or geographical information
o A local telephone company for Yellow Pages directory information
o A credit report company
o A local chamber of commerce

We reserve the right to combine the information contributed by these third party information providers with PUBLIC and PRIVATE information collected through the use of the Vibase.

Third Party -- Agents

We may employ third party companies and individuals as agents to perform certain functions on our behalf. Examples include direct mail marketing, credit card settlements and outsourced customer services. The agents may have access to your PRIVATE and CONFIDENTIAL information but solely to perform their functions. They are bound by contract not to use it for any other purposes.

Third Party -- Business Partner 

We reserve the right to combine and aggregate PUBLIC information with your PRIVATE information to determine what products and services may be beneficial to VIP members. Our goal is to deliver the right offers to the right VIP members, who we believe will find the offers of value. The development of an offer is managed under strict conditions designed to safeguard the security and privacy of our VIP members. We will not provide your PRIVATE information directly to third parties. When we partner with third-party business partners to provide specific products and services to VIP members, we may use both PUBLIC and PRIVATE information. However, our business partners cannot contact VIP members directly.  Instead we will contact VIP members on their behalf. (An example of this type of offer would be a business partner offering accounting services at a promotional rate to VIP small business owners.) In this way we do not share this information with our third-party business partners and we control how you are contacted to ensure your privacy. 

You, as a VIP member, will control whether you want to respond to the offers. Remember, if you decide to take advantage of an offer from our business partner and become their customer, the business partner may wish to independently send future offers to you. In this case, you will need to inform them separately if you wish to decline their invitation to receive future offers.

We never provide CONFIDENTIAL information to our business partners, neither directly nor indirectly.

Third Party -- Law Enforcement 

We will cooperate fully with all Federal, State and Local law enforcement agencies as required by the law or legal process to provide information about a VIP member. If properly subpoenaed, we will provide PUBLIC, PRIVATE and CONFIDENTIAL information to the requesting law enforcement agency.

CORRESPONDENCE

We will contact our VIP members on a regular basis using either email or postal mail. Our goal is to aggregate information about important site updates and features announcements from us, community events from local organizations, and valuable offers from our business partners into a single correspondence. We respect your time and resources and believe we should control the frequency of our correspondence - your VIP membership is not an invitation for us to begin "spamming" you.  By controlling the frequency of our correspondence, we believe each and every correspondence with you will be valuable to you. Because our correspondence will contain important information related to your VIP membership, you may not unsubscribe or opt-out of this correspondence. However, all VIP members have the right to not pursue an offer or promotion from our business partners. VIP members may exercise this right by simply not contacting the party extending the offer or promotion.

When we request information from you through surveys or contests, participation in these surveys or contests is completely voluntary. You have the choice to not disclose information requested which may include contact information (such as name and shipping address) and demographic information (such as zip code or age level). Contact information is necessary to notify the winners and award prizes. Survey information will be used for monitoring or improving the use and satisfaction of this site as well as collecting information of value to our business partners.

EXTERNAL LINKS

The Vibase web sites contain links to other sites that are external to the Vibase. We are not responsible for the privacy practices of those sites. We encourage you to be aware of when you leave our sites and to read the privacy statements of each and every external web site that collects personally identifiable information. This privacy statement applies solely to information collected by us at the Vibase web sites.  

SECURITY

We take every precaution to protect your PRIVATE and CONFIDENTIAL information, both online and off-line. 

• Online, we use Secure Sockets Layer (SSL) software to encrypt CONFIDENTIAL information from your browser and our Vibase web sites.
• Online we request you to enter your VIP username and password to access your PUBLIC, PRIVATE and CONFIDENTIAL information. It is important that you protect your password. Be sure to always sign off when using a shared computer.
• Off-line, only authorized personnel have physical access to the machines that contain your data.
• Off-line, we have trained our staff on our security and privacy practices.

Note: By implementing a strong security policy we are reducing the risk of someone misusing or altering your data. However, we do not provide a 100% guarantee that this can never happen.

BUSINESS TRANSFER

Customer information is considered a business asset that is customarily transferred during a business transaction, such as an acquisition of Viba Fima or the Vibase web sites by another party. Our policy for the transferance of this confidential information is commonly known as an "opt-out" policy. After giving you notice, we may transfer your PUBLIC and PRIVATE information, as a part of this business transaction without your permission. You can have your information removed from the transfer ("opt-out") by canceling your VIP membership before a deadline to be determined and communicated to you in the event of this business transaction.

Our policy of transferring CONFIDENTIAL information is commonly known as an "opt-in" policy. We will NOT transfer your CONFIDENTIAL information unless you give us your permission, after receiving notice of the transfer, to transfer your CONFIDENTIAL information. Without your explicit request ("opting-in"), your CONFIDENTIAL information will be removed from our records before we transfer this asset to the acquiring party. Note: If  you have your CONFIDENTIAL data deleted and continue to use the Vibase services after the asset transfer, the new owner may require you to re-enter your CONFIDENTIAL information. 

CORRECTING AND UPDATING INFORMATION

Most, if not all, PUBLIC, PRIVATE and CONFIDENTIAL information that you provide to us can be edited by you. You may sign into the Vibase and look under the General Information heading.

You can cancel your free VIP membership at any time. If you ever do so, we will delete your PRIVATE and CONFIDENTIAL information from any online access. We may keep that information in off-line backups, until it is purged through our normal business processes. However, your VIP membership cancellation will not automatically remove your PUBLIC information from our business systems. This information has become the property of Viba Fima upon its entry and will only be removed at our discretion.

CHANGES TO OUR PRIVACY POLICY

Our Privacy Policy is intended to provide you with a safe and secure environment to reach more customers. However, since offerings and technologies change, we reserve the right to change, modify, add or remove portions of our Privacy Policy at any time without prior notice. If we decide to change our Privacy Policy, we will post those changes on the Vibase web sites so you can be aware of these changes. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify you. You will have a choice as to whether or not we use your information in this different manner. We will use information in accordance with the Privacy Policy under which the information was collected. Please periodically review our Privacy Policy for changes.

DISPUTE RESOLUTION

If you feel Viba Fima has not adhered to this stated privacy policy please contact us as soon as possible.
